In response to the recent Alabama Supreme Court ruling that has put in vitro fertilization (IVF) at risk in the state, Rep. Nancy Mace introduced a House Resolution expressing support for IVF. However, the resolution does not do anything to actually protect the procedure. The resolution is nonbinding, which means it would not have any effect on federal law.
The resolution simply express support for IVF and calls on elected officials to "proactively pass legislation to protect access to fertility care and assisted reproductive technology, including in vitro fertilization."
In addition to this nonbinding resolution, Rep. Mace has come under fire for being a co-sponsor of the Life at Conception Act, a measure that was introduced in both 2021 and 2023, would have established that life begins at fertilization. The proposed legislation, which has not advanced since last year, could have led to a situation similar to what happened in Alabama. Two weeks ago, the Alabama Supreme Court ruled that embryos created through IVF can be considered children.
