Rep. Nancy Mace this month introduced two pieces of legislation involving the prosecution of online sexual offenders and adding protections for victims - the SUE Voyeurs Act and the Increased Accountability for Nonconsensual Pornography Act of 2024.
“As the threat of online sexual assault continues to expand, it's imperative we take decisive action,” Rep. Mace said. “Every individual deserves to feel safe, which is why our office remains dedicated to introducing legislation that delivers justice where it's needed most. Now, it's time for Congress to act.”
The key provisions of the Increased Accountability for Nonconsensual Pornography Act of 2024 include:
- Increasing penalties for perpetrators to deter future instances of nonconsensual pornography from $150,000 to $500,000.
Key provisions of the Sue VOYEURS Act introduced earlier this month include:
- Establishing a civil action for individuals whose intimate visual depictions are captured without consent in circumstances where there is a reasonable expectation of privacy.
- Allowing recovery of actual damages or liquidated damages of $150,000 for each intimate visual depiction captured, along with the cost of the action, including attorney's fees and other litigation costs.
- Allowing for the preservation of the anonymity of the plaintiff by granting injunctive relief maintaining confidentiality through the use of a pseudonym.
